Terms of Service

These Terms of Service govern your access to and use of Flowtux websites, software, products, support channels, APIs, and related services. By accessing or using Flowtux, you agree to be bound by these Terms.

1. Eligibility and Acceptance

You may use the service only if you have the legal capacity to enter into a binding agreement and are authorized to do so on behalf of yourself or the organization you represent. If you are using Flowtux for an organization, you agree to these Terms on behalf of that organization and represent that you have authority to bind it.

If you do not agree to these Terms, you must not access or use the services. Additional product-specific terms, order forms, or written agreements may apply to certain services and will control to the extent they conflict with these Terms.

2. Accounts and Use of Service

You are responsible for maintaining accurate account information, safeguarding login credentials, managing user permissions, and all activities that occur under your account. You must promptly notify us of any unauthorized access or suspected security incident involving your account.

Subject to these Terms, Flowtux grants you a limited, non-exclusive, non-transferable, revocable right to access and use the services for your internal business purposes. We may modify, update, or improve the services from time to time as part of ongoing product development.

3. Acceptable Use

You agree not to, and will not permit others to:

  • Use the services in violation of applicable laws, regulations, or third-party rights.
  • Interfere with or disrupt the integrity, availability, or security of the services.
  • Attempt to gain unauthorized access to accounts, systems, or networks.
  • Reverse engineer, copy, frame, scrape, or misuse restricted parts of the platform.
  • Upload malicious code, spam, deceptive content, or material that infringes intellectual property.
  • Use the services to develop a competing product through unauthorized access or extraction.

4. Customer Data

As between the parties, you retain ownership of your data, content, configurations, and materials that you or your authorized users submit to the services. You grant Flowtux the rights necessary to host, process, transmit, analyze, and display Customer Data solely to provide, secure, support, and improve the services in accordance with these Terms and our agreements with you.

You are responsible for ensuring that you have all rights, consents, and permissions needed for the Customer Data you provide and for the instructions you give through the services.

5. Billing and Payment

If you purchase a paid subscription or service, you agree to pay all applicable fees, taxes, and charges in accordance with the pricing, order form, or plan terms presented to you. Unless otherwise stated, fees are quoted in the applicable billing currency and are due according to the agreed billing cycle.

Paid subscriptions may automatically renew unless canceled in accordance with your plan terms. Fees are generally non-refundable except as required by law or expressly stated in a separate written agreement. We may suspend or downgrade access for overdue amounts after providing notice where appropriate.

6. Intellectual Property

Flowtux and its licensors retain all rights, title, and interest in and to the services, software, documentation, branding, models, interfaces, and related materials, including all intellectual property rights. Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.

We may use feedback, suggestions, or ideas you voluntarily provide without restriction or obligation, and you agree that such submissions do not create any confidentiality or compensation obligation unless separately agreed in writing.

7. Third-Party Services

The services may interoperate with or contain links to third-party products, websites, integrations, or services. Flowtux does not control and is not responsible for third-party offerings, and your use of them may be subject to separate terms and privacy policies.

We provide compatibility or integration features for convenience only. The availability of any integration does not imply endorsement, and we are not liable for interruptions or issues caused by third-party systems.

8. Disclaimers

To the maximum extent permitted by law, the services are provided on an as-is and as-available basis. Flowtux disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and that the services will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the maximum extent permitted by law, Flowtux will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the total aggregate liability of Flowtux arising out of or relating to the services or these Terms will not exceed the amounts paid or payable by you to Flowtux for the services giving rise to the claim during the twelve months preceding the event giving rise to liability.

10. Suspension and Termination

We may suspend or terminate access to some or all of the services if we reasonably believe that you have materially violated these Terms, if your use poses a security or legal risk, if payment is overdue, or if suspension is necessary to protect the services, customers, or third parties.

You may stop using the services at any time, and you may cancel subscriptions in accordance with your plan terms. Sections that by their nature should survive termination will survive, including sections relating to payment obligations, intellectual property, disclaimers, liability limits, and dispute provisions.

11. Governing Law and Disputes

These Terms are governed by the laws specified in any applicable order form or separate written agreement. If no separate agreement specifies otherwise, disputes will be resolved in the courts having competent jurisdiction over Flowtux's principal place of business, subject to applicable mandatory consumer or commercial law.

12. Changes to These Terms

We may update these Terms from time to time to reflect service updates, legal developments, or business changes. When we do, we will post the revised version on this page and update the effective date above. Your continued use of the services after the updated Terms become effective constitutes acceptance of the revised Terms.
